In order to solve this problem, the United States enacted “The Trademark Modernization Act of 2020 (TMA)“, which added ex parte expungement and reexamination proceedings for cancellation of registration when the required use in commerce of the registered mark has not been made. On the other hand, in China, trademark squatting is a long-term headache for foreign companies who try to enter the Chinese market. Recently, China has revised the Trademark Act in order to fight against trademarks that are registered in bad faith.
